Tragedy at Mt. Weld.

TWO WELL-KNOWN DISTRICT PROSPECTORS
IMPLICATED
JAMES McCRACKEN AND HARRY ROBERTS.
McCRACKEN SHOT DEAD
ARREST OF ROBERTS ON CHARGE OF MURDER.

The usual serenity of the outback country was considerably ruffled on Sunday by the news that a man named James McCracken had been shot dead by his camp and mine mate, Harry Roberts. The scene of the tragedy was near Mt. Weld, about 40 miles in a southerly direction from Laverton. Roberts and McCracken owned a claim and had been working it for some time. Others in the neighbourhood knew that rows had been taking place between the pair, and matters culminated in McCracken being shot.
Death must have been instantaneous, as a man named Kerridge who was camped near by, on being called by Roberts, rushed up, and found McCracken dead. It is alleged that Roberts stated that he and McCracken had an altercation as he was going to water the horses, he having a rifle in his hand, said that during the scuffle which ensued the rifle went off, shooting McCracken dead. An intimation of the occurrence was sent to Laverton, and Constable O'Loughlin started for the scene, in company with Dr. Hurst and Mr Lloyd, J.P. A jury was empanelled, and after viewing the body the inquest was adjourned to Laverton for to-day.
Roberts was arrested, and will be brought before the justices to day. The affair caused a great sensation, as both participants were well known here. McCracken, who was 34 years of age, was highly esteemed, being a great personal friend of Dr. Laver and other prominent old residents of the district.
He was a man of first class education, unassuming nature, undoubted integrity, and one for whom no one had but a good word to utter. Up till about 12 months ago he was connected with the local firm of Logan & Co. as accountant, being a personal friend of Mr. John McCalmont, the manager. As evidencing all the good qualities above referred to, the funeral, which took place on Monday evening at the Laverton cemetery, was the largest which has yet taken place in this district. The procession was headed by a number of Masons, of which order the deceased was a member. The service at the grave was read by the Rev. S. Ray Rooney, and the mortuary arrangements were carried out by Mr. J. Blethyn.
NOTE: Harry Roberts was eventually acquitted.

Death of James Nolan
Magisterial Enquiry

A magisterial enquiry concerning the death of James Nowlan, reported in the last issue, was held at the Laverton Court on Monday, before Mr. H. Johnston, J P. (acting Coroner), and a jury, consisting of Messrs P. G. Edwards (foreman). J. J. Brophy and M. Repacholi, Jack Seghiezzi, through an Interpreter, stated that he was a miner working at Lancefield. At about 6 o'clock on the morning of the 9th inst, he heard a noise near his camp, situated close to Alfonsos garden, on the west side of the Lancefield mine. He went towards where he thought the noise came from, and found an overturned cart, with a horse attached, and man pinned underneath. The man was apparently dead, and the horse was lying on its back. The man held the reins in his hand.
He sought assistance, and three or four, including Mr Reynolds, came, and we lifted the cart off the body, which was cold. In reply to the coroner, the witness said the noise he heard sounded like that of a horse kicking or struggling. Frank Reynolds, manager for Reynolds and Mundy, butchers of Laverton, corroborated the evidence of the previous witness as to his arrival on the scene of the accident.

He was on his rounds when Seghiezzi called him. After assisting to extricate the body, and having sent for Constable Kennedy, he inspected the gate post and he could see where it had been struck by the off wheel, which had run halfway up the post, causing the cart to turn clean over. The horse was lying on its back, and the deceased held the reins in his left hand. There was no sign of deceased having struggled.

Nowlan was employed to cart meat from the slaughter yard to the Lancefield and Laverton shops. On the 8th inst the deceased left Lancefield for Laverton at about 7 pm, the night was wet and dark. Witness did not see him when he returned about 10 p.m. The horse was a quiet one and must have been trotting when the accident happened. The post had slight lean towards the west but was like that before the accident happened. The deceased must have gone astray, as he was on the wrong road.

George Richard Milbank, hotel keeper, at Lancefield, stated he heard deceaseds voice in his front bar about a quarter to 11 the night of the 8th inst, and he left a few minutes later. Hearing of the accident on the following morning witness, at Reynolds request, rode for the slaughter yards to inform Mundy of the accident. On the way he picked up deceased's tracks. He followed the wheel marks to below the mine manager's house where the horse had evidently turned round, two or three times. Deceased had got on the track again and drove to within half a mile of the slaughter yard, where he turned round again two or three times, and then went back towards Lancefield, then to an old brick kiln, from where they turned towards Alfonso’s garden.
Death would have been instantaneous. A verdict was returned that James Nowlan met his death on the morning of the 9th inst by accident, from injuries received through the cart he was driving overturning and falling upon him.

CORONIAL INQUIRY.

An inquiry into the circumstances connected with the death of Urban O'Keefe, who was accidentally killed at the Ida H G M on Sunday, was held at the Laverton Courthouse on Thursday, Mr H, Johnston, J P., was the acting coroner and Messrs J. Dwyer (foreman), C F. Cray and N Davies comprised the jury. Mr Rockett represented the Mines Department, Mr Blayney the mine and Mr McGregor the Miners Union. J. H. Warren gave evidence regarding identification of the body.

Herbert Carey stated that he was a timber man and assistant carpenter on the mine. On the 10th inst he was working afternoon shift repairing the shaft between the l000ft and 1100ft level. There were three of them, including the deceased, at the time of the accident. Deceased was working about 30ft above him. At about 6 p.m. deceased said the pump was racing at the 1000ft level and he said he would go up and stop it. He went up and after an interval of a few minutes he heard something falling down the shaft He went up to the plat at the 1000 ft level and stopped the pump and went into the cistern and called out. "Is there anybody there?" He went back to the shaft and the cages were then moving.

He waited to see who was going down, George Michell, the surface foreman, was in the cage and witness told him he thought O'Keefe had fallen down the shaft. They went to the bottom of the shaft and there, found. the body of O'Keefe in a small pool of water. They pulled it out and were satisfied that life was extinct. Witness had no idea as to how O'Keefe fell off the ladders. Presuming deceased fell from the the plat the distance would be about 200ft. To the Inspector of Mines: The ladder way where deceased was supposed to have fallen off was only used for effecting repairs to the shaft. The ladder way was a satisfactory one for the purpose for which it was required.

There were no men working in the mine at the time except the engine driver and the four men concerned in the accident, viz, Michell, O'Keefe (deceased), himself and Merelli. He did not think it probable that the man could have been knocked off the ladder by the cage. Jack Merelli stated that he was working with deceased at the 1100ft level at the time of the accident. The latter left him to go and stop the pump at the 1000ft level. Witness did not see deceased fall down the shaft. He saw Michell and Carey go down and bring the body up. The jury returned a verdict that deceased mat his death by accidentally falling from the 1000ft level to the 1200ft level at the Ida H GM and that on the evidence there was no blame attachable to anyone.

TRAGEDY AT MOUNT MARGARET.
SENSATIONAL SHOOTING CASE.
A CONSTABLE KILLS A MINER.

A sensational shooting affray occurred here yesterday morning, resulting in the death of a man named James Palmer. It appears that Palmer had been drinking for some time past, and in consequence of his unruly behaviour had been frequently cautioned by Constable Hay, who kept a close watch upon him. On Friday night the constable entered a shanty in town, where Palmer and some others were drinking. Palmer resented the constable's presence, and during an angry conversation said he would shoot the police officer in the morning. Constable Hay accordingly took precautionary measures, placing his rifle and revolver handy upon retiring.

Next morning, seeing Palmer coming towards the police camp, the officer called upon him to stand, whereupon Palmer discharged a shot from a revolver, which, however, did not take effect. Palmer then turned to run, and the constable, with a view to stopping him, fired over his head with a rifle. After Palmer had got down the roadway a few paces, he turned, and while in the act of raising his arm to take aim Constable Hay fired again, when Palmer instantly dropped. The affair naturally created a good deal of excitement in the district when it became known in the afternoon. A formal inquiry was opened by Dr Harst, J.P., and it was adjourned for a week. Palmer was an American and carpenter by trade. He was usually considered a quiet fellow. He had been working on the Cragiemore mine. The deceased bought the revolver from a local storekeeper the day before the occurrence.

ACCIDENT AT THE EURO
A MINER KILLED.

An accident of a most unfortunate nature occurred at midnight on Wednesday, resulting in the death of a miner named Christopher Pellas. From what we can gather, the shift was being changed in the water shaft, and the deceased and another miner named John Walsh were descending in the bucket when the accident happened. In some unaccountable way the "monkey" set over the bucket to guide it between the stays caught and remained suspended, whilst the bucket in which the two men were riding continued on its way down the shaft, and after a considerable distance had been left between it suddenly became free and gaining impetus in its downward flight it struck the bucket with such force that both men were thrown out on to the centre timbers.
Walsh, seeing that his mate was injured, caught him and held him until help arrived. It was a perilous position for Walsh, as the slightest slip would have meant a fall of over 140ft. When the alarm was given, Archie Collins went to the rescue, and the two men were brought to the surface. Pellas injuries were of such a nature that death must have been instantaneous, but Walsh escaped with a cut on the hand and a few abrasions on the body.

Pellas was an old prospector in the district, and a man for whom everyone had respect. He was a Russo-Finn and had been on the fields for about five years. He had no relations nearby, but a brother is thought to be at Harcourt, in Victoria. Pellas will be remembered by miners who worked at the Hawks Nest, Mt Morgans, and the Erlistoun, as an honest, hardworking man, who only worked for wages to get money to go prospecting with. The deceased was buried on Friday morning in the Laverton cemetery, and the whole of the employees of the mine attended the funeral as a tribute of respect to their dead comrade. Mr. C. J. Callanan conducted the service.

Death of Mr. Gus Reichelt.

In last week's issue of this paper, it was our regrettable duty to have to report that Mr A Reichelt, an old identity of the northern goldfields, had on Thursday become prostrated through the bursting of a blood vessel, which had left him in a critical condition. It was thought by his many friends that after the first attack of haemorrhage had ceased he would, with proper attention and careful nursing, recover. High hopes of his recovery were in general circulation but, unfortunately, it was not to be, and on Friday a resumption of haemorrhaging occurred, and his chance of leaving the institution alive became considerably discounted.
Shortly after 12 o'clock on Saturday night death claimed him as its victim.
The late Mr Reichelt, who had not been in the best of health for some time, was suffering from a cold, which apparently had settled on him, and in addition to that it is now believed that he was the victim of some internal growth, which perhaps was the actual cause of death.

Up to the time of the unfortunate turn deceased had always attended to his duties as a partner in the local butchering firm of Reynolds and Mundy. The late Mr Reichelt, who was 47 years of age, was a native of. Castlemaine, Victoria, which place he left while in his teens, and proceeded to Queensland, where he put in a good many years of his youth. He, like many others, was attracted to W.A by the outbreak of the goldfields, and for a number of years he followed prospecting in the Erlistoun district, where eventually, when mining progressed he, with Messrs Donald Mundy and Peter McNie opened up a butchering business. Mining development, unfortunately, in the place mentioned, shortly afterwards slumped, and they opened a similar business in Laverton and Lancefield.
Deceased married the widow of the late Mr Gilbert McGrath, who will be remembered by many older residents as having occupied the position of accountant at the Craiggiemore mine, Laverton. Some two or three years later was solemnised in Perth about four years ago. The issue of the union has been two boys, aged four and two respectively, who, with their mother, mourn their loss. In addition a boy of seven, a stepson, shares the ill fate. The funeral took place on Monday afternoon, and the procession was one of the largest that has been witnessed in the district, there being 36 vehicles well filled with late friends, a few on horseback, and several Brethren of the Oddfellows' Lodge to which deceased belonged, walking in front of
 the hearse.

Laverton and Beria Mercury 22 November 1919, page 1

Naturally some consternation was caused on Sunday afternoon last at about 1.30 when the dead body of Robert Sangster, a well-known resident of the district for about 18 years, first as a prospector and latterly for a number of years an hotelkeeper at Burtville, was found in the urinal at the rear of the Public Hall, Laverton. Deceased, who had been-financially worried for some time, came to Laverton on the previous Monday afternoon and stayed at Lewis's Grand Hotel. Bob, as he was familiarly known, was usually of a jovial nature and during the last days he spent in Laverton his many friends did not notice much alteration in his demeanor.

However, on Saturday morning shortly after 10 o'clock he left the hotel, and no notice was taken of his absence until late that evening when, knowing he had not returned home and was not at any other place in town, his friends began to ask the question, "Have you seen Bob Sangster anywhere?" it was thought he may return during the night, but as that did not happen anxiety became increased and a search was instituted. As the day progressed the fact that he was missing was

passed around generally, until at last a lady who lives not far from where the body was found, said that she had seen deceased enter the place referred to above about 11 o’clock on the previous morning. An investigation was made and the prostrate body was discovered with a glass which had contained a liquid, presumably cyanide, and a bottle containing water.

The remains were removed to the morgue by the police and a post mortem examination was made by Dr Hill, but, as the inquest, which was formally opened by the acting coroner and a jury on Monday morning was adjourned to the 26th inst, the result of his finding is not yet known. The funeral took place on Monday afternoon when a large number, including many from Burtville, followed the remains to the Laverton Cemetery, where the funeral service was read by Mr W. Leonard. The pall bearers were Messrs. W. Leonard, W. Gaston, P Gorman. B. Gilbert, B. Bunny and T. James, Mr A. Davey carried out the mortuary arrangements. Wreaths were sent by the residents of Burtville, the Laverton postal staff, Mr and Mrs Pinder, Mr and Mrs Davies, Mr and Mrs Lewis, and Mr and Mrs Milbank and others. The late Mr Sangster left a wife and six children, the oldest of whom is about 14, to mourn their loss.

A Prospector's Death
Fall of Earth in Stope
Evidence at Inquest

As a result of injuries received in a fall of earth at the D.B.D. mine, nine miles north of Cox's Find, on October 18, David Lionel Silva (38), married, prospector, of Laverton, died at the Laverton Hospital on October 14. An inquest into his death, conducted by Mr. A. Pinder, J.P., and a jury of three, was held at the Laverton Courthouse on Tuesday.

After hearing lengthy evidence, Mr. Pinder recorded a finding of accidental death, with no blame attachable to anyone. Clarence Henry Christians, prospector, said he and a mate were prospecting near, the D.B.D. mine, which Silva and two other prospectors were working. He brought the big kibble from his show over to the D.B.D. shaft and Silva was raised to the surface. He complained of injuries to the left leg, stomach, and spine. He was attended by the sister at the Cox's Find first-aid room, and then rushed to the Laverton Hospital in the mine truck.

Christian's mate, Alfred James Jones, said Angrove, one of the party working the D.B.D. mine, had called him between 8 p.m. and 9 p.m. on October 8, telling him that there had been a bad fall of earth and that Silva was badly hurt. Silva appeared to be lying propped against the wall and was badly hurt. After treatment by Sister Morrell at Cox's Find, Silva had said that he did not think he would last the journey into Laverton.

William George Haywood, prospector, said he was working the D.B.D. mine, about 45 miles north of Laverton, with Angrove and Silva (who was also known as Fisher). About 8 p.m. he was down the shaft with Silva and Angrove was on the windlass. Silva was sitting down for a spell when about a ton of earth fell on him. 'I was at the end of the stope when the dirt fell. I heard Silva call out and went to him,' he continued. 'The dirt that fell on him was a kind of schist and the ground had been tested and seemed all right. We were going to timber it later. We managed to get the dirt off him somehow and got him to the surface.

He was badly hurt. Dr. Myles of Laverton said Silva was brought to the Laverton Hospital early on October 9. He had severe injuries to the abdominal wall and other injuries and bruises. The injuries were consistent with a man sitting and earth falling on him. His condition, although serious, seemed fairly satisfactory until late on October 13, when it took a turn for the worse. He died the following day at 4.30 am. Ernest Dudley Silva, brother of the dead man, gave evidence of identification. Silva, he said he was living apart from his wife. There were no children of the marriage.

SUPPOSED SUICIDE
FREDERICK TRAYES THE VICTIM.

Much surprise and regret were caused on Thursday, shortly after midday, when information was conveyed to the local police that the dead body of Frederick Trayes had just been found about a quarter of a mile from the Laverton Brewery. Senior-Constable Malone, accompanied by P.C. Williams were taken to the spot, where they found Trayes dead body lying on its back with a double-barrelled breechloading gun discharged in one barrel lying alongside and pointing straight to deceased's chin, under which the shot had entered and blew the left side of the face away and a portion of the skull through which it made its exit.
The police removed the body to the local morgue, and expressed the opinion that the case is one of undoubted suicide. Deceased must have laid on his back on the ground prior to firing the shot, as there was not the slightest indication of any struggle or disturbance in the ground at the spot at which the body was discovered.
From what can be gleaned, Trayes left the camp of Mr. T. Cook, at the Laverton Brewery, about 6.30 in the morning, with the expressed intention of looking for a wild turkey. Shortly after he had gone Mr. Cook heard a shot. A few hours after, recollecting that deceased had stated that he would return to breakfast, Mr. Cook went in search of him, and, to his great surprise, found him as previously stated. Until recently Trayes had been in the employ of Mr. E. E. Allanson, of Morgans, for whom he had been managing a branch store at Laverton, now occupied by Messrs. Brown and Peters. After winding up the Laverton business the unfortunate subject of this article related to Mr. Allanson's Morgans business for a few weeks. He left, and returned to Laverton about a fortnight ago, and had been camped at the brewery up to the time of his death.

There was no apparent cause for the rash act, and Trayes is stated to have been in very good spirits all along. ‘Freddy’ Trayes, as he was popularly known, had been a resident of the northern goldfields for some five or six years, and had, wherever it had been his lot for fate to locate him, made himself a useful and desirable citizen. He was engaged with the firm of Tobias Bros at Malcolm, and was for some time secretary of the race club of that place. Afterwards he was in the employ of Mr. Peter Hill at the same town. He then came to Laverton, where, as stated above, he was engaged by Mr. Allanson, and during his sojourn here had been connected with various public bodies and was always one of the first to lend assistance to any commendable object. A formal inquiry was held before the acting-coroner, Mr. Campbell Shaw, and a jury, and adjourned to Wednesday next. The funeral took place yesterday afternoon and was largely attended. The Rev. H. S. Jarvis read the burial service and Mr. J. Blethyn conducted the mortuary arrangements.

Death of Frederick Tummel
Coronial Inquiry

An inquiry into the circumstances surrounding the death of Frederick Tummel, of Laverton, whose dead body was found by the police in the Government dam on Monday, was held at the Laverton Courthouse on Wednesday. Mr. H. S. Mackenzie acted as coroner, and the following comprised the jury - Messrs R. L. Thompson (foreman), W Leonard, and J. Carlon.
Dr. C W. Laver gave evidence as to having examined the body of deceased, on which there were no marks of violence. Death was due to drowning. Constable Campbell stated that in consequence of a report made to him on the 10th by John Mader about the deceased Tummel, he went in the bush to make a search. At 1.30 p.m., in company with the a tracker, he went to the Government dam and there found the dead body of Tummel floating on the water.

There were tracks leading to the dam where deceased walked in. The body was fully dressed, the water was about 8ft deep where the body was found. On Tuesday. 11th inst, with the tracker, he followed the tracks of deceased from the road to the racecourse to the fence surrounding the dam. Deceased had evidently gone through the wires, and from there to an old outhouse in the enclosure. They there discovered deceased's overcoat (produced). Followed the tracks to the north-east corner of the dam where deeased had evidently laid down.

The tracks then led to the by-channel which goes into the dam, and from there into the water. Mader had told him that deceased had left his (Tummel's) place about 3 o'clock on Monday morning. He remembered the deceased being lost some time ago when he was out in the bush for a night. John Mader stated that he was a baker residing at Laverton. He made a report on Monday to Constable Campbell about Tummel leaving his home at 4 o'clock on the same morning. He saw Tummel coming out of his front door and asked him where he was going so early. Deceased said he was going for a walk, as he had had a sleepless night. He also said that he felt weary and dry. He invited him to go into the bakehouse and warm himself, but. he declined.

Of late he had been depressed, and at times appeared to be wrong in his mind. When Tummel did not return he became somewhat anxious about him and made a report to the police. He identified the body at the morgue as that of Frederick Tummel. To the jury; It might have been possible that deceased went to the dam to get a drink and fell in, and was too weak to recover himself.
Hardwig Wallace stated that he was a baker in the employ of Charles Wells, Laverton and had known deceased about two years, he had been on good terms with him. The deceased came to him on August 28th, and told him that he was in trouble, he said he had an order for a suit of clothes from a man at the Lancefield ; he had not paid him a deposit, and he did not know what to do, as the firm he had been dealing with in Perth had stopped his credit; he asked witness to lend him £1 for a week and a half. He told him he only had two or three shillings on him at the time but told him he would lend him a pound on the following day, which he did. He also said that he could not sleep. He came to the witness a day or two afterwards with a waistcoat, which he gave him as a present, he did not think deceased would commit suicide. The jury returned a verdict that deceased came to his death by drowning whilst suffering from temporary insanity, caused by financial worry and sleeplessness.

THE CASE OF JAMES WHYTE
Letter to the Editor.

Dear Sir - I wish to give a few facts that may not be generally known re Constable Hunter's trip to look for the lost man Whyte. Whyte left Mr Mitchell's place in Laverton, early in November 1914, on foot, taking only two days rations with him to go out east. Mr Mitchell offered him a horse and more rations, which he would not take. There had been good runs and there was water everywhere. About the end of December of the same year the local Aboriginals brought in word that they had seen a white man’s tracks in the spinifex, not much notice was taken.
At the end of January last, Michael O'Malley, Tommy Mason and I saw a white man’s tracks 40 miles east. We followed them for a day, and when we left them, they had left the ranges, the tracks were almost invisible.

I knew the man must be dead. To my idea there had been a great deal of time before the police took any action. About three months ago the local Aboriginals brought in word that they had seen the remains of a white man a long way out. A week before Christmas, Constable Hunter, another man and two Aboriginal boys with four camels went out to search for the remains. I saw Hunter at the 18 mile well and old him I thought the Aboriginals were taking him on a wild goose chase. Hunter said he would go on and see if the remains were where they were supposed to be. I told him I was sure he would have a rough time of it. To my great surprise Hunter returned to Laverton on the 3rd of this month with Whyte's remains, which he had fund in a cave on a mountain which I had named Mt Dungey, 110 miles from Laverton. Hunter is deserving of the greatest credit knowing the country. He had no water for the camels for five days and very little for themselves.

No doubt Whyte died from starvation, as there had been plenty of water about. I am very pleased that Hunter cleared up the mystery, and I am sure Whyte's relatives and friends will be also. Constables Thompson (officer in charge) and Hunter deserve great credit for the manner in which everything was carried out.
